In Illinois, if you have separated from your employer, the next question on many employee's minds is when is the final paycheck due?
If the employee is fired, the check should be paid at the time of separation, if possible, but not later than the next pay day. 820 ILCS 115/5. The same is true if the employee quits. Id. If the employee requests that his/her final pay be paid by check and mailed to the employee, the employer must comply with this request. Id. The Illinois Department of Labor enforces this law and provides assistance to employees in the collection of wages or final compensation. While I realize this is not employment-law related, I think it is a major result from the November 6th election (this past Tuesday).
Puerto Rico voted in favor of statehood. In the referendum that passed, Puerto Ricans were asked if they wanted statehood, continue with their current territorial status, or seek independence. For Puerto Rico to fully achieve statehood would take a vote in the U.S. Congress in favor of statehood. This would require a simple majority vote. If Puerto Rico is approved for statehood then it would become the 51st state in the United States of America. It is election day! I hope that all of you exercise your right to vote today.
